1. Provider Identity
The site is operated by CV. NGALAM INDONESIA RESERVE COFFEE, with registered office at Jl. Jombang No. 16, Malang, Jawa Timur 65115, Indonesia. Customer contact: hello@nircoffee.id.
2. Definitions
- "Site" means nircoffee.id and any subdomain operated by us.
- "You" / "User" means any visitor to the Site or person placing an order, whether as a guest or registered user.
- "Account" means a registered user profile on the Site.
- "Order" means an offer to purchase Products through the Site, accepted by us in accordance with section 6.
- "Products" means coffee, brewing equipment, and related goods listed for sale on the Site.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract under Indonesian law in order to place an Order or hold an Account. By using the Site you confirm that you meet these requirements.
4. Account & Responsibilities
You are responsible for keeping your Account credentials confidential and for all activity that takes place under your Account. Notify us immediately at hello@nircoffee.id if you suspect unauthorised use. We may suspend or terminate Accounts used in breach of these Terms or for fraudulent activity.
5. Products & Pricing
All prices are in Indonesian Rupiah (IDR). Shipping costs are calculated at checkout based on destination and courier choice. We strive for accuracy but reserve the right to correct pricing or specification errors before an Order is accepted; if a corrected price is materially higher you may cancel the Order at no charge.
6. Orders, Acceptance, and Cancelation
An Order is an offer by you to purchase Products. We accept the Order when we send a confirmation email AND payment has been captured — by Xendit for credit / debit card payments, or received in our designated BCA account for QRIS and virtual-account payments. Until that point we may refuse the Order, including (without limitation) for stock availability, suspected fraud, or pricing error. You may cancel an Order at no charge before it has been dispatched; after dispatch our Refund Policy applies.
7. Payment
We accept payment through multiple channels: credit and debit card payments are processed via Xendit, our authorised card-payment partner; QRIS and virtual-account payments are received through our partnership with PT Bank Central Asia Tbk (BCA). Available methods may vary based on order value and customer type. We do not store full card numbers; tokenised card references held by Xendit are used solely for refund processing. Refunds are returned to the original payment method per the Refund Policy.
8. Shipping & Delivery
We dispatch from our warehouse at Jl. Jombang No. 16, Malang, Jawa Timur. Our delivery responsibility is limited to: (a) selecting goods that match your Order, (b) packaging them appropriately, (c) generating an accurate shipping label and AWB, and (d) handing the parcel over to the third-party courier you selected at checkout (or its appointed pickup agent) at our warehouse. Once the courier has accepted custody of the parcel at our warehouse, our delivery obligation under these Terms is complete and risk of loss transfers to the carriage relationship between you and the courier. After handover, the carriage of the parcel is governed by the agreement between you and the courier (and any aggregator such as KiriminAja used to broker that service). We are not the carrier and have no operational control over the courier's network. To the maximum extent permitted by law, we are not responsible for events that occur after handover, including: in-transit damage, loss, theft, or non-delivery; delays caused by the courier's network, weather, public holidays, regional disruptions, or force majeure; additional surcharges levied by the courier (remote-area, oversize, redelivery, return-to-sender, COD, customs); failure of the recipient to be available at the address provided; and losses caused by an inaccurate, incomplete, or subsequently changed delivery address. Estimated delivery times displayed at checkout are courier-published estimates and are not a binding promise. Claims for in-transit damage or loss must be filed with the courier using the AWB / tracking number; on request we will supply evidence of dispatch (proof of pickup, packing photos) to support such claims as a courtesy. Nothing in this clause limits your non-derogable rights as a consumer under UU No. 8/1999 (Perlindungan Konsumen) or other applicable Indonesian law, including your right to refund or replacement under our Refund Policy where a Product was missing, incorrect, or defective at the time of dispatch (i.e., a fault attributable to us, not to the courier).
9. Returns & Refunds
Our return, refund, and cancelation policy is set out in detail on our Refund Policy page. Nothing in these Terms limits your mandatory rights under Indonesian Consumer Protection Law (UU No. 8/1999).
10. Wholesale Terms
Wholesale customers are subject to a separate Wholesale Agreement, which supplements (and where it conflicts, prevails over) these Terms. Apply at /wholesale/apply.
11. User Content & Conduct
When you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with operating the Site. You must not submit content that is unlawful, defamatory, obscene, infringes intellectual property, or violates anyone's privacy.
12. Intellectual Property
The Site, including its design, code, branding, photography, and copy, is owned by CV. NGALAM INDONESIA RESERVE COFFEE or its licensors and is protected by Indonesian and international intellectual-property laws. You may view the Site for personal, non-commercial use only. Any other use requires our prior written consent.
13. Disclaimers & Limitation of Liability
The Site is provided "as is" without warranties of any kind beyond those that cannot be excluded by law. To the maximum extent permitted by Indonesian law, our total aggregate liability arising out of or in connection with the Site or any Order is limited to the amount you paid for the Products in the Order giving rise to the claim. Nothing in this section limits liability that cannot be excluded under Indonesian Consumer Protection Law (UU No. 8/1999) or for fraud or wilful misconduct.
14. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your misuse of the Site, or your violation of applicable law.
15. Termination
We may terminate or suspend your Account or access to the Site for breach of these Terms, fraudulent activity, or as required by law. Termination does not affect rights and obligations that accrued before termination.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or in connection with these Terms that cannot be resolved by good-faith negotiation shall be submitted to the exclusive jurisdiction of Pengadilan Negeri Malang.
17. Changes to These Terms
We may update these Terms from time to time. The version date at the top of this page indicates the current version. Material changes will be communicated to existing users via email or in-app notice; continued use of the Site after the effective date constitutes acceptance of the revised Terms.
